Welcome to the website www.sagomobilecorporation.com, including its features, applications, services, or associated websites ("Website"). On the Website, you will find a complete range of new or used phones, tablets, smartwatches, and other accessories offered by Sago ("Product(s)"). These terms and conditions ("Conditions") govern your use of the Website and the sale of Products between Sagau mobile inc, the operator of the Website and the seller of the Products on the one hand ("Sago" or "we"), and users of the Website or buyers of the Products on the other hand ("Customer" or "you").
Please read these Conditions carefully because they constitute a contract between you and Sago when using the Website and making any purchases of Products. If you do not agree to these Conditions, please do not use or transact on the Website.
When you use the Website or make a purchase, you agree to comply with: (i) these Conditions; (ii) any other policy that Sago may adopt from time to time in relation to the Website; and (iii) any applicable laws or regulations related to your use of the Products or the Website, including but not limited to copyright laws.
These Conditions may be changed at any time by Sago, to the extent permitted by law, in which case the most recent version will automatically replace the previous one. If changes are made, we will take steps to notify you, either by a notice on the Website or otherwise. Your use of the Website after such modification constitutes your acceptance of the revised Conditions. In the event a Customer refuses or fails to accept the Conditions in effect at the express request of Sago, their access to the features offered by the Website, including the ability to purchase Products, may be suspended.
The Website is intended only for adults with the capacity to contract. The use of the Website and the creation of an account by a minor is prohibited. By accessing, using, or making a purchase on the Website, you declare that you have reached the age of majority in your place of residence.
You have the option to create an account to purchase Products. If you do so, you are responsible for protecting your password and any activity on your account, whether authorized or not. If you become aware of or reasonably suspect any unauthorized access to your account, including theft, loss, or unauthorized disclosure or use of your password, you must immediately report it to us using the contact information provided in the "Contact Us" section below.
Purchase of Products
The receipt of an order by Sago does not automatically mean it is accepted. All orders are subject to confirmation by a representative of Sago, who reserves the discretion to cancel or refuse any order within five (5) business days. In the event of an error in entering Customer information or Product price, inability to deliver, or any other reason, we will contact you to notify you and provide a full refund of any amounts collected at the time of the order, including taxes and any delivery charges. Please note that the processing time for a refund varies depending on the Customer's financial institution.
Additionally, some Products may be available in limited quantities only. If a Product is no longer in stock when the Customer places an order, despite Sago's efforts to synchronize real-time inventory, a representative will inform the Customer, and any additional delivery time will be communicated at that time. If the Customer prefers to cancel the order, Sago will also refund the full amount.
Once confirmed, an order can only be modified or canceled by the Customer if the Products have not yet been shipped. Otherwise, Sago's return and refund policy will apply.
Pricing
The prices of Products are displayed and payable in Canadian dollars. Unless otherwise indicated, prices do not include applicable sales taxes or delivery charges (if applicable), which will be calculated at the applicable rate at the time of purchase. All prices are subject to change without notice.
Payment
When you make an online purchase of a Product, the full payment of the Product price and all applicable fees and taxes will be collected at the time of the order. If a Product is unavailable or the order is otherwise rejected, you will be reimbursed as provided herein.
Payment for your purchase is made by credit card or other digital payment methods through the secure section of the Website, using third-party service provider platforms. The security of banking information provided when purchasing a Product is governed by our privacy policy available at the following link: [Privacy Policy](https://www.buysago.com/policies/privacy-policy), which the Customer acknowledges having read and understood by accepting these Conditions.
For security and fraud prevention, credit card payments are only accepted if the billing name and address match the name on the Customer's credit card and the address on the credit file. In the event that your identity cannot be validated, Sago will have no obligation to process your order.
Delivery
Delivery is free across all of Canada for all mobile devices, tablets, and smartwatches.
Delivery times generally range from 2 to 8 business days, depending on your province of residence. We will attempt to process your order on the same day if it is received before 12:00, or on the next business day otherwise. An express delivery service is also available for an additional fee.
Please note that delivery times may vary, including due to the type and quantity of Products purchased, the delivery location, holidays, etc. Delivery is also performed by third-party service providers over which Sago has no control, and such providers may also cause unforeseen delays.
Any delivery time provided to the Customer at the time of purchase is indicative only, and Sago cannot be held responsible for delays or delivery failures resulting from circumstances beyond its control. Nonetheless, Sago will make reasonable efforts to ensure delivery times are met.
Products offered on the Website are available for delivery in Canada only.
Safety and Maintenance
Products may have inherent safety risks if not used properly. Batteries, for example, can be a source of burns or other injuries if punctured or impacted. An electronic device should only be opened or repaired by a professional. It is also the responsibility of the Customer to read any user and maintenance manuals for the Products they purchase, including any safety warnings, as applicable.
Product Warranty
Sago guarantees that the Products sold will be free from any design or manufacturing defects and will be functional ("Warranty") for a period of 90 days from the date of receipt of the Product by the Customer ("Warranty Period"). Warranty claims must be made directly to Sago within a maximum of 10 days following the expiration of the Warranty Period. A return merchandise authorization number ("RMA") in the form of a label must be obtained from Sago before returning any Products and must be on the packaging used for shipping as a prerequisite for accepting the return.
Sago will inspect the returned Product within a reasonable time and, in the case of a defect covered by the Warranty, Sago may, at its discretion: (i) repair the Product; (ii) replace the defective Product with a conforming Product; or (iii) refund to the Customer the purchase price of the Product.
Please note that no warranty will apply in the following cases: (i) damage caused by an accident, fall, or other impact, contact with a liquid, misuse, fire, or any other external cause or attributable to the Customer; (ii) damage caused by the repair of the Product by any person not authorized by Sago.
